If a court has acquitted you, Islamabad police can no longer print that old FIR on your character certificate. Justice Ayyaz Shaukat of the Islamabad High Court has ruled that mentioning a case after a final acquittal is unlawful and breaks the Constitution, and has told the Islamabad police chief to fix the system so acquitted people do not have to come to court for a clean certificate.

What happened in this case

A citizen went to the high court because his police character certificate still referred to an FIR registered against him at Shalimar police station in Islamabad, even though the case had ended in his favour. The police had also described him as “discharged” during the investigation.

The court allowed the petition, ordered the FIR reference removed and declared the certificate unlawful. It said the word “discharged” undercut what the acquittal actually meant: once a court clears someone, police have no legal basis to present that person as an accused.

Why the court said it breaks the Constitution

The judge found the FIR mention violated Articles 4, 9, 14 and 15 of the Constitution: the right to be dealt with according to law, the right to liberty, the dignity of a person and freedom of movement. Someone who has been cleared through due process cannot keep paying for it through a document that hints they are still tied to a criminal case, the court said.

One line from the ruling will sound familiar to anyone who has queued at a police station: citizens should not be forced to approach the courts to get rights the law already gives them.

Can police still keep the record?

Yes. The court said police may keep details of criminal cases in their internal records for official use. What they cannot do is disclose those cases on a certificate handed to the citizen, especially one needed to travel or work abroad.

Why this matters for people going abroad

A police character certificate is one of the first papers asked for in visa, overseas job and immigration files, and in many local job applications. A stray FIR line can sink an application even when the person was found innocent. For workers heading to the Gulf or students applying abroad, a clean certificate after an acquittal can decide whether the file moves at all.

Does it apply outside Islamabad?

The order is directed at the Islamabad police. Punjab has faced a similar question: the Lahore High Court earlier told Punjab police to stop treating acquitted people like convicts on their certificates and to use separate formats. People in other provinces who were acquitted can point to both rulings if their certificate still lists a closed case.

What happens next

The Inspector General of Islamabad Police has to set up a formal procedure so that cases ending in acquittal are left off certificates automatically. Until it is in place, anyone affected should carry a certified copy of their acquittal order when applying, and ask the police to issue the certificate in line with the high court’s ruling.
